Tidal Privacy Policy

1. Introduction
This Privacy Policy describes how Tidal, Inc. ("Tidal," "we," “us,” or "our") processes personal data that we collect through our digital properties that link to this Privacy Policy, including our website (collectively, the “Service”), as well as through social media, our marketing activities, and other activities described in this Privacy Policy, and your rights in this regard. Tidal may provide additional or supplemental privacy policies to individuals for specific products or services that we offer at the time we collect personal information.
Tidal commercializes an underwater camera and machine perception tools to interpret complex oceanic environments. This Privacy Policy does not apply to the processing of personal data on behalf of our enterprise customers (such as businesses and other organizations) while providing the Tidal platform and services to them. Our processing of personal data on behalf of such enterprise customers is conducted as a data processor and the enterprise customers' privacy policy apply for the processing of your personal data. If you have concerns regarding personal data that we process on behalf of such enterprise customers, please direct your concerns to that customer.
Our Services are designed for enterprise customers and their representatives. We do not offer products or services for use by individuals for their personal, familial or household purposes. The Service is not intended for use by anyone under 18 years of age.

2. Personal data we process
We process personal data relating to persons using our Services, contact persons at our customers, service providers and business partners, potential job candidates and others who contact us. The personal data may be provided by you, the enterprise you are engaged by, public sources, our marketing partners or be generated by us.
We process your personal data in connection with the following processing activities:
- Provide and operate the Services; Tidal will process the Service users' name, e-mail address, position and workplace to the extent necessary to provide and operate the Services. The legal basis for such processing is Tidal's legitimate interest in providing the Services and ensure that these Services are provided securely and with satisfactory quality (GDPR Article 6 (1) (f)).
- Improve the Service and our business; Tidal will process the Service users' name, email, workplace, and feedback to improve the Service and our business. The legal basis for such processing is Tidal's legitimate interest in improving (GDPR Article 6 (1) (f)).
- Personalizing the Service; Tidal will process the Service users' devices from which you have previously logged in and your selections and preferences as you navigate the Service to ensure that your personalized choices are kept. The legal basis for such processing is Tidal's legitimate interest in providing a Service that suits your preferences (GDPR Article 6 (1) (f)).
- Communicate important information about the Service, including by sending announcements, updates, security alerts, and administrative messages; Tidal will process the Service users' name, e-mail address, phone number and position to communicate important information about the Service. The legal basis for such processing is Tidal's legitimate interest in keeping the Service users informed about user relevant information about the Service (GDPR Article 6 (1) (f)).
- Communicate with you about events in which you participate; Tidal will process your name, e-mail address, position and workplace to communicate important information about events and operations in which you participate. The legal basis for such processing is Tidal's legitimate interest in keeping the participants informed about practical information about events (GDPR Article 6 (1) (f)).
- Marketing by e-mail or phone; Tidal will process your name, e-mail address, position and workplace to send you marketing materials by e-mail or on LinkedIn. The legal basis for such processing is your consent (GDPR article 6 (1)(a)).
- Contract management and business relationships; Tidal will process name, e-mail address, phone number, position and workplace of contact persons at enterprise customers and business partners, in addition to personal data contained in contracts, ongoing commercial correspondence, invoices, minutes of meeting etc. The personal data is processed to administrate such business relationships and be able to fulfil rights and obligations following the contract with such enterprises and enforce other terms and conditions that govern the Service. The legal basis is Tidal's legitimate interest in entering into business relationships, fulfilling contracts and administrating such relationships (GDPR Article 6 (1) (f)).
- Compliance with legal obligations; Tidal will process your personal data, such as name, position, workplace and e-mail address, to comply with applicable laws and lawful requests, such as to respond to subpoenas or requests from government authorities. The legal basis is our legal obligation to conduct such processing (GDPR Article 6 (1)(c)).
- Protect legitimate interests; Tidal may process your personal data, such as name, position, workplace, e-mail address, e-mail correspondence and your interaction with the Service, to protect our, your or others’ rights, privacy, safety or property (including by making and defending legal claims), prevent, identify, investigate and deter fraudulent, harmful, unauthorized, unethical or illegal activity, including cyberattacks and identity theft. The legal basis is Tidal's legitimate interest in protecting our and others' legitimate rights (GDPR Article 6 (1) (f)).
- Cookies and similar technologies; Tidal uses cookies and other information gathering methods to allow the technical operation of the Service, enhance the performance and functionality of the Service and to help us understand user activity on the Service, including which pages are most and least visited and how visitors move around the Service. Personal data such as IP address, country code, country, state and geo coordinates and your use of the website or clicks on our e-mails may be processed. The legal basis for processing of personal data to enable the website to function (necessary cookies) is our legitimate interest in making the website function (GDPR Article 6 (1)(f)). The legal basis for the other processing of personal data in relation to cookies is your consent (GDPR Article 6 (1)(a)).
- Business transferees; Tidal may process personal data such as name, position, workplace, e-mail address and employment contract in relation to business transactions (or negotiations of or due diligence for such transactions) involving a corporate divestiture, merger, consolidation, acquisition or reorganization, sale or other disposition of all or any portion of the business or assets of, or equity interests in Tidal (including, in connection with a bankruptcy or similar proceedings) or a third party enterprise. The legal basis is Tidal's legitimate interest in organizing its business in the most optimal way, obtaining capital or buying assets from or stocks in other enterprises (GDPR Article 6 (1) (f)).
- Recruitment; If you apply to a position in Tidal, Tidal will process your personal data in order to assess your application such as contact information, notes from the interview, CV, application, certificates, references and other information you may provide or which we need to verify to assess your application. The legal basis for such processing is normally that it is necessary in order to take steps at the request of the candidate prior to (potentially) entering into an employment contract (GDPR article 6 (1)(b)). We will not be able to asses your application if this personal data is not provided to us. The processing may also be based on our legitimate interest in finding the best candidate for the position (GDPR Article 6 (1) (f)).
In addition, we may process information about you from public sources and persons you have stated in your application to conduct investigations to assess you as a job candidate. The processing is based on our legitimate interest in finding the best candidate for the position (GDPR Article 6 (1) (f)).
3. How we share your personal information
We may share your personal information with the following parties:
- Service providers. We may share your personal data with third parties that provide services on our behalf or help us operate the Service or our business (such as hosting, information technology, customer support, email delivery, consumer research, marketing, and website analytics). These service providers will act as processors and their processing of personal data will be regulated by a data processing agreement.
- Professional advisors. We may share your personal data with professional advisors, such as lawyers, auditors, bankers and insurers, to obtain professional services from such third parties. 4. Retention period
Tidal will retain your personal data for as long as it is necessary to fulfil the purposes for processing as defined above.
If the processing is based on your consent, your personal data will be deleted if you withdraw your consent. You can withdraw your consent at any time.
5. Your rights
As a data subject, you are entitled to request access to the personal data we process about you and request that Tidal updates or corrects your personal data if the requirements for such rights are fulfilled. You may also withdraw any consent to processing at any time. In some circumstances, you are also entitled to request that your personal data is erased, request restriction of processing or object to processing and/or request data portability. To utilize your rights, you may contact Tidal by using the contact information stipulated in section 1 above.
You are also entitled to lodge a complaint with a supervisory authority if you believe that Tidal's processing of your personal data is contrary to relevant data protection laws.
You may opt-out of marketing-related emails by following the opt-out or unsubscribe instructions at the bottom of the email, or by contacting us. Please note that if you choose to opt-out of marketing-related emails, you may continue to receive service-related and other non-marketing emails.
6. Other sites and services
The Service may contain links to websites, mobile applications, and other online services operated by third parties. These links and integrations are not an endorsement of, or representation that we are affiliated with, any third party. We do not control websites, mobile applications or online services operated by third parties, and we are not responsible for their actions. We encourage you to read the privacy policies of the other websites, mobile applications and online services you use.
7. International data transfer
We are headquartered in the United States and may use service providers that operate in other countries outside the EU/EEA. Your personal data may be transferred to the United States or other locations where privacy laws may not be as protective as those in your state, province, or country. All processing in a country outside the EEA will be subject to mechanisms ensuring sufficient security for your personal data in accordance with GDPR Chapter V, such as EU Standard Contractual Clauses or an adequacy decision from the EU Commission. 8. Changes to this Privacy Policy
If we make changes to this Privacy Policy, this Privacy Policy will be updated, and the change will be notified on the Service or by use of your contact information if it has been provided.
